Contract and Release Form

Please read the following prior to your shoot:

1. Scope of Work:

  • This contract is for services and products related to a photography shoot between Lillian Liu Photography and Client.

  • The Photographer and Client are to arrive for the shoot at their at their arranged time and date, and flexibility for tardiness will be at the discretion and availability of the Photographer.

  • The Photographer agrees to provide no fewer than the agreed number of edited photos for the client after the shoot, and is not required to provide more than this number of images.

  • The Photographer, if offering styling, will offer no more than the advertised looks/pieces for the shoot. The Photographer is not responsible for sizing issues or garment alterations, and the Client is responsible for checking their own measurements prior to the shoot.

2.) Fees:

  • In consideration for the services provided by Lilian Liu Photography, the Client agrees to pay the fixed and advertised sum as noted on their invoice.
    The Client agrees to pay the photographer a non-refundable deposit totaling $50 to secure their booking. This initial payment reserves the photographer’s time. Should the Client cancel their shoot for any reason, the deposit will not be returned.

  • The Photographer will reserve this time exclusively for the Client, and will not advertise the same availability to any others.

  • The balance of payment for completed services must be paid in full no later than 7 days upon receiving final images.

  • If the Client is wanting to purchase edits separately after the shoot, payment for those photos is due upon receipt of invoice.

  • Due to the nature of this transaction, no refunds can be given after the shoot has been completed, or after final edits have been saved by the Client.

  • Refunds or reschedulings are available should there be a cancellation on the Photographer’s end due to circumstance (bad weather, technological breakdown/failure, illness). Should the Client require rescheduling due to illness or circumstance, advance notice is needed.

  • Clients are given one free re-edit of any final image to work on any fixes necessary. Further fixes are then subject to Lillian Liu Photography’s hourly rate.

3.) Product:

  • The Photographer will deliver final edits no later than 2 weeks after the date of the initial shoot unless otherwise arranged.

  • The client understands and agrees that selecting from raws and proofs are allowed before the editing of the final image, but that proofs are exclusive property of the photographer and will need to be purchased separately as separate edits. The client will not automatically obtain a right to raw images except for a viewing license, and cannot store or publicly share the proofs.

4.) Indemnification:

  • The Photographer and Client both agree that the Photographer is under no obligation to capture any specific moments or poses during the shoot if deemed unsafe for the model or Photographer. Should the Photographer be unable to perform the services covered by this contract due to safety, the Client agrees to indemnify the Photographer for any loss damage or liability.

  • The Client agrees to indemnify and hold harmless the Photographer for any liability, damage, injury, or loss during the shoot.

  • The Client understands that garments and accessories are delicate, and that they are to be handled with care. For situations featuring extremely delicate and expensive couture garments pulled from a designer, the Photographer may ask for a fully refundable damage deposit prior to the shoot at either their discretion or the designer’s discretion.

  • The Client understands and agrees that the Photographer is not required to maintain raw copies of photos from the shoot after 60 days have passed after final images have been delivered.

5.) Client Responsibilities

  • If shooting on location in a specific requested place, the Client agrees to obtain all permits necessary for the Photographer to shoot should it be required. The Client agrees that failure to obtain these permissions resulting in fines to the Photographer, is not the responsibility of the Photographer.

  • The Client understands that the Photographer is exclusive unless otherwise arranged, and that there is to not be a second shooter present.

6.) Model Release

  • The Client grants permission to the Photographer permission to use the Client’s image or likeness online in their portfolio, for advertising, and for providing to third parties and print, unless there is a privacy arrangement previously discussed should there be sensitive content involved.

  • The Client cannot sell their finalized images, and they are for personal use only.
